Subject: An Urgent Civics Lesson.

To: All Americans:

November 7, 2006 reflected another desperate, if futile effort by about fifty percent of the American voting public to salvage America from a dysfunctional federal government; the other fifty percent have given up hope. Yet the franchise is perhaps the only alternative to Thomas Jefferson’s observation that “The tree of liberty requires the nurturing of the blood of patriots and tyrants from time to time”. However Jefferson and others prescribed a procedure, if properly exercised, that could preclude this necessity. That procedure is stipulated in Article Five of the Constitution. The Bill of Rights and other guardians of “ liberty and justice for all” have arisen as a result of the application of that article.
It is the Constitution, not the federal government, that is the guarantor of our liberty. And when that government has evolved into a structure that places this country in peril, that document must be applied to remedy that threat. Otherwise we run the risk of hearing the hoofs of the four horsemen of the Apocalypse resound in our streets.
Most Americans are at least intuitively aware that “something is rotten in Denmark” (Washington DC). In order to arrest the usurpation of the government by lobbyist through corrupt legislators or other elected officials who sell themselves for thirty pieces of pork, articles one and two of the Constitution must be rewritten.
It is a regrettable fact that a large majority of Americans are ignorant of the details contained in the Constitution so a brief civics lesson is necessary as a first step in addressing the problem. The first three articles (of a total of seven) simply establish the structure of the Federal government. Article one describes the structure and-(“intended” my quotes) areas of authority of the Legislative Branch (Congress), Article two establishes the Executive Branch headed by a President, (whose only requirement for the job is “a natural born citizen—and to have attained the age of thirty five years) and Article Three the Judiciary consisting of the Supreme Court and “in such inferior courts as the Congress may, from time to time, ordain and establish”. All of these articles require less than two pages of small print.
Article five prescribes the method and manner of amending the Constitution, and that has been done twenty eight times, the first ten of which are known as The Bill of Rights. Article Five is quoted below in its entirety.
The Congress, whenever two-thirds of both houses shall deem it necessary, shall propose amendments to this constitution , or, on the application of the legislatures of two-thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this constitution, when ratified by the legislatures of three-fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress. Provided, that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article;, and that no state, without its consent , shall be deprived of its equal suffrage in the senate.
While this article makes the fox (Congress) the guardian of the hen house, every single members, although bought and paid for by special interest groups, owes his position to voters on election day. Therefore if that vast majority of voters who, according to every major poll is disgusted with Congress, would demand that their state legislators and their congressional representative pursue such action as is suggested herein it is possible that this generation could leave to their posterity the same guarantees of liberty as the Founding Fathers intended.
However a preliminary step must be initiated by each state legislatures if amendments to the constitution are to accomplish this objective. A series of regional pre-conventions will be required composed by the most learned men and women in public and private life whose task shall be to draft proposed amendments to Article One and Two of the Constitution that will correct the abuses that now threaten this nation. For example access to raid the treasury of the United States through the practice of pork barreling must be “rendered” from the Constitution. The terms of office of members of the House of Representatives and other practices must be reviewed to correct the ills that have become endemic within these two branches of the federal government. President George E. Bush, and a number of his predecessors certainly establishes the need to assure that that a president possesses other qualifications than those currently enumerated in the Constitution. When those proposals have been approved in these regional conventions than a national constitutional convention should be convened for the purpose of approving such of these proposals as the convention may then adopt.
Our forefathers bequeathed to us the most precious gift they could bestow. Can we do less in maintaining it for our posterity?
